Eviction or not??

I would like some advice from the group on how I should approach this situation. I am negotiating a property that has a tenant who has been living there under a verbal agreement with the sellers late husband. The tenant has not made any rental payments and the seller doesn’t want to deal with this person. Do I have to formally evict the tenant, even though there is no written lease agreement, once I take ownership of this property? Look forward to hearing from you all!
