I have an Apt. issue, need advice

i signed a lease in April for an apartment. Move in date was for May 7th. We took a look at the apartment and everything semed OK, until the day I got the keys. i noticed the carpets in what would be my sons room were disgusting and not livable especially for a toddler. also there is construction going on in the apartment that is still not finished.

Now he is telling apartment is being rented as is, i offered to split the cost of a new carpet with him and he refuses. He said the carpet was there when you saw the apartment. True it was, but some thing go unnoticed when you see an apartment at night. his offer was to vaccuum it....

now we are not moved in yet, we cant move in - until the work is done. he said if I feel this is not going to be the apartment for me, to let him know.. I would tell him to forget and go find something else but he has my first months rent and security and I want it back. This is an Illegal apartment if that means anything.,
