NO SMOKING ADDENDUM

Hi Everyone!

Just curious what you do regarding "no smoking" and whether you have a section in your lease regarding smoking or not. I want to include a section in my lease for no smoking as I have seen and heard horror stories and do not want to deal with it ever again. I had to tear down and re-popcorn a ceiling due to a tenant smoking in his bedroom and am done with that so please tell me if this NO smoking section from my lease would work, oh and I do not see that Minnesota does not state that I cannot have this in my lease agreement so I am planning on rolling with it for now. Any advice or input is always welcome!!

My NO SMOKING section on current lease states:

"16. NO SMOKING: Neither the Tenant(s), guests, nor any person shall be allowed to smoke in the premises, and agrees to limit the burning of candles and incense. Any violation shall be deemed a material violation of the Residential Lease Agreement. Tenant understands that any damages caused by smoking any substance will be considered damage. Damage includes but is not limited to: deodorizing carpet, wax removal, additional paint preparation, replacement of drapes, repair or replacement of carpet, counter-tops, or any other surface damaged due to burn marks and/or smoke damage. Tenant agrees to pay $50.00 per day to ionize the premises to remove any unwanted odors, and $5.00 for each cigarette butt found on premises."
