Holding Fee Agreement Form

Good Afternoon BP,

I am looking to find a Holding Fee Agreement Form.  I have an apartment I will be holding for an approved tenant for the next three weeks. The tenant has agreed to a holding fee of $1,000 to cover that time. As with most holding fee agreements, if they move in within that time frame I will apply that fee to their security deposit. If they do not move in, I will keep the fee.

Does anyone have an agreement form created already. I searched the FilePlace but did not find anything.

Here's our language.  We do a rental agreement and a holding deposit form at the same time.  The rental agreement clearly states that it does not start until the future date.  At move in we trade cash for keys, paperwork is done.  They can get kids enrolled in school, utilities set up, etc prior.

Holding Deposit

Receipt is hereby acknowledged of one hundred fifty dollars ($150.00) Holding Deposit from ____________ (Applicant) to hold the rental unit at the following address: _______________ until November 24th, 2014.

If the unit is not available at the agreed upon date the landlord will make a full refund of the deposit without interest, and with no liability or penalty to either party. If the Applicant gives notice of cancelling the rental agreement prior to November 24th, Applicant will forfeit one hundred fifty dollars ($150.00) of the Holding Deposit. This Holding Deposit will be applied to the non-refundable and security deposit when Applicant takes possession of the above-described unit. If Applicant fails to take possession without prior notice, Holding Deposit will be applied toward the November and December rent obligation.

Receipt of one copy acknowledged.
