Florida Abandonment Laws

Zoe Long
Posted

Hey everyone!

I have a tenant who has abandoned one of my rentals. By Florida law I can go change the locks and reclaim the premises...but here's the problem. She left some other people living there.

I want to make sure this is well documented that it truly was abandoned because I don't want the risk of her deciding to turn around and sue me...but how do i prove that when the utilities are on and furnitures still there? She hasn't paid me anything in a few months and it has been over 30 days since she has been there. Also, I have served her a 3-day notice. No one else is on the lease, and no one else was living there originally but her.

Any help is appreciated.
