Can I lease the place to new(second) tenant?

I have a situation. My tenant is not paying rent for last 3 months and I started eviction process. Getting court hearing dates are really taking longer time. I am not able to pay mortgage without getting the rent. I have a new tenant who is ready to move-in and live with them/or make them vacate. He knows the entire situation and ready to sign the lease. Can I have the lease with second tenant and rent the place? How can I get the rent from first tenant? 

Any suggestions are greatly appreciated?
