Tenant wants M2M lease due to roaches
My tenant of 29 days is asking for a month to month lease so she can find a new place due to roaches. She sent me this long formal letter asking me to change her annual lease to month to month because she is seeing roaches in the unit. I have tried to mitigate the problem for weeks now and have even addressed it with the HOA and Board of Directors because it's a building problem that is invading my unit now. I've tried all the recommendations you guys have suggested but I feel like she is grossed out by bugs and it's been very extra. The building general area is being treated monthly but the individual condos are up to each owner. I just bought it late last year ans never really saw any issues since it was fully renovated and hadn't been lived in in over a year. So this was shocking to me and her.
My realtor and her manager said “No, I am not aware of this being an acceptable means to unilaterally change the terms of the lease. Both parties are bound to the lease and would be in default if they terminate prior. Suggest the landlord seek legal counsel as to their rights to enforce said lease.
I’m torn because I don’t want anyone living there that doesn’t want to be there. But I also realized she has tried to get her rent reduced twice before this was even ans issue which makes me feel like it’s a money thing also. Not saying roaches aren’t an issue because they are but I do feel like she’s being a bit extreme when she’s seeing maybe one roach every other day or so.
