Water line damage from tunneling company

My rental in Del Valle needed its foundation leveled. After leveling the home the hydrostatic test failed. Plumbers recommended the sewer line be replaced. 

Hired the foundation company to tunnel under the home to expose the sewer line. The guys doing the tunneling then punctured the main water line in several spots. 

Plumber comes back out and found the main water line and all pipes throughout the home was Kitec so now I have to repipe my entire house. 

Right now my concern is to get the home livable again but am curious if the foundation company that did the tunneling is liable at all since it was Kitec and needed to replaced anyways. The pipes were in perfect working order before but almost feel like this event has saved me something bigger down the road. Whats yalls thoughts?
