Room rental situation - How fast can I get this person out?
Yet another tenant problem has arisen in my insane little universe.
So, I have a tenant who has given her 30-day notice that she is leaving. This person believes that she is loved and wanted by all and was offended that we were not begging her to stay (or so I'm assuming) and has begun to act up horribly.
It is a room rental and I rent a second room. My second tenant cannot sleep at night because this girl is either talking very loudly on the phone or she's blaring music and the walls between those two rooms are apparently thin. That was news to me.
She is out on February 28th, for sure, but she is insisting on staying through that month unless we return her last month's rent up front. She says it is a deposit. It was not a deposit, basically. It is the first and last month's rent up front. That said, my other tenant has been sleeping on the couch because she cannot get any sleep in her room.
When I attempted to bring this up to the nocturnal noise-maker, she insisted that she is not loud and the other girl likes sleeping on the couch and it's not her fault. She proceeded to basically say, "If you are going to blame me for everything just give me my deposit back and let me leave now."
I refuse to do that. I'd rather put up with her being an infant than let her get that one over on me.
Now, it gets even more complicated. She physically attacked my other tenant. The tenant is looking into getting a restraining order. What would this do? As I understand, it would force her hand and make her move out early. Has anyone else ever had this problem or do I just have insanely bad luck?
What is the minimum legal notice I can give her to get the hell out of my house while still keeping her last month's rent?
We are at a boiling point. I have one tenant who is not comfortable in what is basically her own home. I am very hospitable, and then I am personally afraid to leave the house because I don't want her to get mad and damage something.

An exparte order , or a restraining order would get her out , but I hear lawyers beating on the front door soon after .
