Duplex issue - noisy neighbors
I accepted new tenants to one side of a duplex Oct. 1, 2013. They have since had a party approximately once per month. Each time the tenant in place on the other side of the duplex has called and complained about the noise.
One one such occasion my husband drove over and spoke to the new tenants about the bass from their stereo. When he left it was turned back up for about 1/2 an hour then off, but the tenants then got into a short but heated argument.
Some facts:
- In place tenant has a 2 year old
- In place tenant has given notice, she plans to leave before March 1
- Notice in place tenant would like to move was given prior to new tenants taking possession.
- New tenant lease expires 9-30-14
- Complaints to date have only been about the bass
- Parties do not result in property damage
- All of the parties have ended before 11 pm
- Both tenants pay their rent on time and in full
- Both tenants keep a clean house
- My town does not have a noise ordnance.
- My lease does state - "Will Conduct themselves and require other persons on the property with Tenant’s consent to conduct themselves not to disturb, annoy, endanger, or interfere with their neighbor’s peaceful enjoyment of the property. " & "Will not Disturb the peace and quiet of other tenants or neighbors. "
We have spoken to the new tenants twice but as I mentioned the noise ends by 11 pm.
