Reimburse legal fees for rent court?
I was speaking with the PM company I use to file my Failure to Pay Rent and Warrant of Restitution papers and she asked if I am getting the fees I pay her (the PM company) reimbursed by the tenant as "Additional Rent".
I, for some reason, thought that the money I paid to hire them to do the court stuff for me was just lost money....that I could only get back the actual court fees and late fees.
She said that as long as it was spelled out in my lease as Additional Rent, I could add those legal fees to their following month's rent.
So far, I drew up this paragraph to add to my lease. Does it look good? What do you have? How would you edit this, if at all?
"Legal Fees. The Tenant(s) will be responsible for paying legal fees in relation to rent court, to include legal services. Court fees are typically included in rent court filings. However, any legal fees incurred will be Additional Rent."
