Toilet leak gone unnoticed for years because of caulking

I own a condo and my plumber found a toilet leak when recaulking ,the wax gasket never made contact with floor and there is lots of water under the toilet , not a flooding scenario , the toilet base is 100% caulked held in the water for years and there is no gap left in the back , now I need help if HOA can help here or would it be the owner responsibility?I was not aware of this because of what I stated earlier and probably there before I purchased it ,any guidance on how to approach this?
