Eviction case in progress + lease will end in 3 months

Posted

All,

I have filed for an eviction case - my tenant has not paid rent for the last 4 months and has delayed the court proceeding by 1 month since I filed for eviction. He has now requested a jury trial - I'm assuming to delay the proceedings

The lease term ends in 3 months

Question: If we don't reach a settlement and we proceed with a Jury trial for eviction, will the tenant have to vacate the property when lease ends or he will continue occupying the property till the court case is complete? The entire case is for eviction - so I think it beats the purpose of dragging a court case and the tenant occupying property after lease end date. Needless to say, we are not planning to renew the lease
