Can my DBA be the Lessor (Landlord) in a Commercial Lease?
Hello Bigger Pockets Community Members!
I am hoping that someone can help shed some light into my situation...
Here are the facts. I am the owner of a commercial property. The title to the deed is under my legal name. I have always exercised the leases under my legal name, Queenie Wang, as the Lessor/Landlord. I also manage these properties myself.
I am looking into creating a dba to manage this property. Let's call it, "Sunshine Properties". I want the rental checks and deposits to go into my business checking account "dba Sunshine Properties" instead of into my personal checking account. I want utility bills and insurance to be under "dba Sunshine Properties" also.
Can I execute the lease with the dba, "Sunshine Properties", as the Lessor/Landlord in the lease agreement without it compromising the validity of the lease or causing any problems down the line?
Since the dba is not a separate entity, would I still need to put my name on the lease for it to be valid?
Any insight based on your personal or professional experience would be greatly appreciated! Thank you!
