Tenant had a stroke. Daughter not responding.

I have a rental property located near Peoria Illinois. The tenant we have, ended up having a stroke and had to be taken to the hospital. He was on month to month lease. He is unable to return to living on his own. The daughter of our tenant said they would get the house cleared put, but has been unresponsive to any messages we have sent regarding when this will be taken care of.

My question is, would I be able to start boxing up the tenants belongins to help the daughter out if we dont hear a response. This is about an hour away from my home, and we have limited opportunities to get there and start the cleanup process. We just dont want to get into any legal issues, but we also want to move forward on cleaning out the house amd getting it back on the market.

    You need to send notice to the daughter about next steps and include a deadline.  Your local attorney can help you draft it so it complies with local laws.

    No, you can't legally just go in and start packing up his stuff.  You need a judge to grant you that right.  The notice that you send to the daughter can offer help, assistance, your warm wishes etc....but in the end you can't perform an eviction w/o a judge deciding if that is what needs to take place.
