Property Damage from Neighbor and Unfinished Work

Hi all,

Wanted to get your opinions on a situation. Long story short, a large building has been under construction next to us for a few years and almost a year ago, due to the damage they caused our backyard, they agreed to fix it for us. So they tore down our retaining wall and put new pavers in. However, instead of putting the new retaining wall where it was before, they put it in a completely different spot further out. Now they're saying that that's not our wall at all - so the first question becomes, where's our wall? Second, they have changed their minds and decided not to put the fence on the wall itself, but in the middle of the pavers, where our old wall is. We paid lots of visits to their constructions site and they're unfortunately very inconsiderate and not trustworthy. Saying they'll get a surveyer out, but never did. Saying they'll let us know when the surveyer come visit but never do. All the while, we wait with a backyard that is dangerous to use (there's a drop with no fencing). 

Wondering if anyone here has come across situations like this. TIA!
