Short Sale and contract expired with previous buyer

Currently working a deal for a short sale the bank has been taking a really long time requiring more and more documents. It's been over 120 days and the buyer's agent told me that their buyers had to think if they wanted to continue/extend with the deal. At this point, the contract has expired. I didn't hear from her in 2 weeks. Since the contract had expired we entrance a deal with a new buyer. Now after not hearing from the other buyers in 2 weeks they want an extension. We are going to release their binder back to them. Can the pass buyers technically sue my sellers?
