Help with advice on legal action

Me and my girlfriend put an offer on some property to build and set a close date . The builder took way to long to get us a price to build and it’s over our budget. We called to extend the closing to try to get more builders involved and the lady is threatening to sue us . We put up earnest money and know they will take that and to beat it all the realtor is acting on her behalf idk it’s crazy should we get an attorney at this point. Thanks for any help .
