Seller Won't Sign CAR Cancellation
I'm sure we've all been in this situation at one point or another where there is a deposit at risk.
I'm a buyer's agent in this situation, and here is the scenario:
1) Buyer has not removed inspection contingency.
2) Buyer cancels contract, sends cancellation to escrow and to seller.
3) Seller agrees to sign but doesn't actually sign.
4) Seller and seller's agent have ceased communication.
So- what would you (especially you CA guys) do?
My thoughts are:
1) File Lis Pendens.
2) File Lis Pendens and move to go to mediation/arbitration.
3) Call seller's agent's broker.
