Divorcing couple with shared rental property.

My Husband and I are seeking a divorce. We also own a home in Co. together, I live in Ca. he is moving to Mo. We want to set the property up as a rental and pay him for investments he has incurred since I moved out and of course eventually it will be income for both of us after he has been payed back. What's the best way to do this and also to insure that his share of the property goes to his daughter if he dies and to mine if I die.

My immediate advice is to forget your plan. I have handled a ton of divorces during my career as a investor and a broker.

The majority these kind of arrangements turn into garbage down the road. So save the future headaches and dump the property now, and leave the marriage as clean as you can. If he wants to keep it just take a secured note for your share and don't fight about it if the market isn't right for selling for you two right now.
