Hi, I have a condo in Evanston (Chicago sub), I am on the board. One of the owners got at leak in their condo, he forgot to turn off the tap. Now the owner below him filed claim to his and her insurance. She also submitted the claim to the insurance of HOA. Her claim to the insurance of HOA is about 75k. Basically she looks to fully repair her condo. She took off the drywall and there is no trace of the leak left. The attorney we currently have advices to confirm the claim based on the bylaws we have. But the way I interpret the bylaws is that the person who did the act of neglect is liable for the damages. We are looking for a consultation with an attorney. I have all files and can send by email to the new attorney.
