AC unit to small for home

I purchased a new home for my family and I to live in. After being in the home for a short period we started to have lots of ac issues. Come to find the investor that owned this home before me installed a 3 ton unit on a 2200 sf home. It needs a minimum of a 5 ton unit. Do I have any legal grounds to get this fixed? Are there local, state, federal laws that would protect a new home buyer from past installations? Anthony
