As a real estate agent can I represent myself and my husband in a real estate transaction using our IRA?

Can I get a commission from this transaction?

As a disqualified party, you may not benefit from or provide benefit to the IRA. As such, we recommend that our licensed realtors have an associate handle their plan transactions. This limitation would not apply to someone who is not licensed, as the acquisition and disposition of plan assets is not a problem in and of itself.

You certainly cannot perform the services of a realtor and be compensated.

It {may} be possible that you could process the transaction and not be compensated, but there is a likelihood that the IRS could view this as providing services of value to the IRA, which would be a prohibited transaction. As a licensed realtor, you bring a lot more to the table than just signing contracts, and that has value.
