Self-Directed IRA Deal

Hi Everyone, 

I'm Breno Soares, I'm starting this discussion looking for some advice on this particular deal I'm trying to put together using my Self-Directed IRA.

Me and my business partner found a 100k 2 bedrom apt, move-in ready where are are looking to put an offer since the rental in this area is in high demand and the numbers make sense. 

Deal Structure:

-  Offer 100k requesting 4k back to help with closing cost, putting 20% down. 

- My part of the deal is to use my name and credit and half of the out pocket cost, his part is the other half of the cost and the property management. 

- I'll be using 10k from my Self directed IRA to cover my out of pocket investment. The problem is that he can not use his name on the deal, but he has the other half of the out pocket available.

What would be the best way to structure this deal?

Its my first deal and i'm looking to do it right. I appreciate all advice and help on this topic.

May want to create an LLC and pool your IRA and his funds in the LLC. The investment would then be made in the name of the LLC.

However, a whole set of rules apply to this type of investment when IRA funds are used. Therefore, you will want to work with a qualified attorney. For example, because you are using your IRA, you cannot guarantee a loan to the IRA nor can you use the IRA funds to guarantee a loan to yourself.
