60 year old oak tree on property line

I have a large oak tree(60-70 years old) that  is starting to look  diseased and a possibility that it could fall on the home next door.   I have talked to the owner of the home next door and he states that I need to cut the tree down, because the previous owner of my property topped the tree off and the tree has grown into his yard over time. (I have owned the property for 3 years)The tree is located on both of our property lines with just a little over 1/2 on mine. I have offered to pay half the cost with the next door owner since the tree has oviously been there a long time and has grown throught the chain link fence. The owner of the home next door does not want to pay half. Thoughts?
