Marketing to foreign investors

Hello,

I was wondering if anyone has any idea about the legality of marketing real estate investments in USA to foreign investors through a US-based website?

I know that if marketing real estate investments on a website to US residents, I would need among other things to market specifically to qualified investors, and demonstrate that I am verifying that prospects are in fact qualified investors, in order to not have problems with the SEC.

But what happens if I market specifically to foreigners (and I demonstrate that I will filter prospects and only interact with foreigners)? Is there some sort of loophole or exemption where the SEC rules would not apply because I am dealing with non-US residents?

If anyone has any reading material to point me to (in particular sections of the SEC rules) that would be great.
