No tax on year one for CA LLC?

I've heard conflicting information concerning tax law where it concerns the 800/yr fee in Ca. My broker has told me that the fee is waived the first taxable year, however I was curious as its just about time to get in contact with my CPA. If it matters, I formed it in around Sept 07, however didnt really use it, except for a few deductions I had planned for start up costs.
