Won the bid, gave earnest funds, forclosure isn't complete yet

Found a fixer upper on the MLS, won the bid, gave 5k earnest funds,paid for insurance and just got a text from my agent that the bank forclosure wasn't complete and the actual out of town investor was scheduled to appear in local court and didn't show and now he has a warrant. I really don't want out of the deal but can I be compensated someway from their legal misdealings?

Can you add more color. What type of auction was this? What do you mean foreclosure isn’t complete? Typically there is either a sale or not?
