Fair Housing Act with LLC

Sam Kay
Posted

Hello BP team!

I recently acquired a duplex under my personal name and plan to owner occupy 1 unit and rent the other. I plan to put the title under a new LLC and this LLC will have this duplex property only. I will be the principal manager of this LLC.

I recently became aware that The Fair Housing Act exempts owner-occupied buildings with no more than four units sold or rented without the use of a broker. I used a real estate agent to secure my duplex.

Question: If my duplex was retitled under an LLC, does this Fair Housing Act exemption still apply? I still plan to occupy 1 of 2 units.

Thank you!

-Sam
