Seller evicting tenant after closing? (MT)

Hi all - complete newbie here. 

We just closed on a great off market deal that has a bit of a family feud going on.  
Daughter is running a business in the top part of the house, and had renters downstairs. Neither were paying rent to the owners of the property. Sellers gave both a 30 day quit notice before closing. Downstairs people have moved out, but it looks like the daughter is going to put up a fight, and we will have to go the eviction route. 
We closed shortly before their 30 day quit notice was up. I assumed we would be taking over the lawyer fees and case. However the sellers have very graciously offered to continue paying attorney fees.  Apparently, the attorney is going to file the suit in their name.  I’m wondering if this is normal, even after the house is sold?  If this does go to court, will the fact that this WILL be our primary residence still stand in court?  

Sorry for the storybook. I will be contacting the attorney as I want to make sure there is no bumps.  Until then I was hoping for some advice.
