SDIRA LLC and syndication. How to fill docs?

Nicolas Boivin
Posted

Hi all,

i have a SDIRA with rocket dollar. I'm currently struggling on how to fill documents for syndication, especially when it comes to making sure it will be compliant for tax purposes come early 2023. Let's say the name of my LLC is ABC IRA, LLC.

More specifically, what entity type do I use? There's usually options like individual, corporation, LLC, TIC, joint tenants and trust. LLC sounds the most logical, BUT some syndicators don't have an option to signal it's a SDIRA. I could use the TIN of ABC IRA, LLC., but since it's a disregarded entity and it's not shown anywhere that it is an IRA, will the IRS come after me for taxes? Should I use the tax id of my custodian? Any guidance is highly appreciated!

@Nicolas Boivin

You state that you obtained a plan from a provider.  Are they not able to assist you with this question?  Usually your plan provider would be your best resource for such questions.

The investor is not an IRA. Rather the LLC that is owned by the IRA is the investor. The LLC is disregarded, and the underlying IRA is the taxpayer. You should complete form W-9 to indicate this relationship.
