Refi as "second home" how long vacant till "legal" to rent?

Refi/Heloc as "second home" how long do you have to leave vacant till it is "legal" to rent? I am pretty sure this can be done and people have done it.

If you do this as a "second home" I have heard that the seasoning requirements are not there at all.
