Lender says that I cannot represent myself as an agent for an investment property
When i acquired my 4th mortgage on my investment property last year November, there was no issue of representing myself as a buyer and agent. Suntrust allowed me to roll my entire commission into closing costs, and was able to put 20% down.
I am now acquiring my 5th mortgage on rental property #5, and the new lender is telling me that i cannot represent myself as an agent and buyer. What can i do in that situation? I just left my other broker as things were falling apart and returned to Solid Source Realty. Can i ask my broker to represent me as the buyer's agent? Will this work?
I've had two mortgages with Suntrust and they will not give me another loan as it my 5th mortgage. It seems the standards are stricter on your 5th loan. I have to put down 25%. I can't believe the lender is telling me that i can not represent myself as the agent and buyer to use my commission for closing costs.
The underwriter feedback is as follows:
With regard to the purchase agreement….it was run by management and they will not allow the borrower to be his own agent. Can the borrower have another agent within his real estate office represent him? If we can go this route, it would be acceptable as we have done this in the past on previous loan(s).
If he can assign a different agent, just have the purchase agreement resigned/initialed with the new agent information and send on over to me for review.
What should i do?
