Sandwich Lease Options - Texas

James Goodman
Posted

First, I've heard and read different answers on whether or not sandwich lease options for single family residential properties are legal. Can anyone give me a solid answer? I've tried reading the law, and I'm no lawyer... the jargon goes over my head a bit...

Second, in regards to the tenant-buyer exercising the option, if they decide to do so, do you have the actually purchase (at least on paper) the property from the seller before selling it yourself to the tenant-buyer? Or, are you essentially facilitating the transaction between the seller and the tenant-buyer, profiting on the difference?
