Quick backstory: I am currently under contract for a 3 unit in New Jersey. We've recently discovered that the town has the home zoned as an R2 (Residential 2), however, the DCA which is conducted by the state in 2015 listed the home as an R3 (Residential 3). Our realtor has submitted the 2015 DCA resignation to the county for review, therefore pending.

My concern is that if the home is confirmed as a 2 family, will I be able to reside in the illegal 3rd unit without issues as an owner occupant.
