"Hidden" Water Damage?

I am currently rehabbing a rental unit that I just closed on. We are replacing an essentially new vinyl floor, which was installed within 30 days of closing. My builder pulled the floor, and found rotting subfloor near a window. This must have been there when the previous owner put down the floor.

Can the previous owner be held responsible for the repair, and if so, what do I need to do?
