LLC for Passive Investing for H1B Holder

Amit Shetye

Hi All,

I need little help understanding the creation and role of an H1B visa holder for a real estate investment LLC. I plan to rent my house starting next month, I am on H1B visa while my Partner is on H4 EAD. We own the home jointly, with the mortgage owner being an H1B holder.

Since we want to rent out the house would like to create an LLC to protect us and our assent from any lawsuits in the future. My question and concerns are there:

How do I structure this LLC, should both H1b and H4 visa holders be part of it or just one?
Can we both directly manage it or is there any restriction or way around it?
Can the money coming as rent be deposited directly to our personal bank account?

Any help or directions will be helpful.
