NOPE @Brie Schmidt If side walk was in your conditions of approval it must be in and passed before recording the plat.
the bond is for the city to charge on if you fail to do the street improvements or your contractor messed them up.. you should ask the city how long your on the hook for warranty of the public improvements it can be one to two years.
like in Gresham I built a 27 home community and my underground guy messed up on some piping and manholes I had to go fix them other wise they would ( the city ) called my bond if they call your bond the bond company sues you . and you will never get another bond..
I also have to replace a man hole this summer.. the underground guy even though this was a million dollar contract he has since gone broke.. so I have to step up and pay for it myself.. bout 25k in total.. but not to worry we can handle it.. but don't like it. And since Oregon and Washington land use laws pretty much mirror each other I think that's about the case. Remember your bond is for public improvements.. sidewalks are usually on your private property... and not the cities responsibility.. so just check your plat and see where it is..
Also the days of bonding for completing and recording plats is over.. cities got burned on those.. developer gets place approved but never follows through the cities generally wont go after the bond and it just sits there I have bought 2 failed projects that were like this.. the bond is a joke really.
