Short seller don't perform

hi,

I am in contract for an approved short sell, but seller's estranged wife (she is not on the title) won't corporate, therefore I can't see, inspect or appraise the property, I don't see any motive for seller to evict his wife and children.

what can buyer do to move it forward? if I just wait, will contract expire after a while?

If your short sale is approved the bank will usually only give you 30 days to close. I would offer the wife cash fo keys to motivate her to leave. Let them know if the house forecloses they will be evicted but this way they can get money out of it.

As far as if your contract expires. You'll have to look and see if you wrote a date in there or SSA (Short Sale Aaceptace) + days. I always write mine SSA. if you dont close by the date specified then the contractbis void. If the sellers wife wont cooperate there really isnt much you can do.

With short sales its a numbers game. About 5% of mine are with uncooperative sellers or divorced couples. I evaluate my butt pain factor and ofd's of the sale going through with seller cooperation before i start the process. I've learned to just pass up front on the difficult sellers.
