Proving vacancy at Foreclosure auction hearing
In my county there is a Court Confirmation hearing after a Sheriff Sale. At the hearing, typically the owner gets 30 notice to vacate and then I can take possession. According to the rules, the 30 days can be eliminated if the property has been abandoned. I have never seen this happen but would like to try it for my current purchase. The property is abandoned. Anyone know , what "proof" does the judge need?
I have dated photos from a MLS listing showing it vacant but can't find the owner.
