Citi taking homeowner to court already. BPO just completed

I got a frantic call from a homeowner today. The BPO was done two weeks ago on their property and we are waiting a response from the lender. The 2nd lien holder Citi, is taking the homeowner to court. He just got served paperwork today. I have NEVER run into this. Citi said they are reviewing the offer along with the first lien holder Wells Fargo.

Has this ever happened to anyone before? The homeowner is in shock and so am I. There was no auction date set...this is out of the blue.

I'm assuming he will have to go to court and show paperwork that he's attempting a short sale.
