Zombie Title in Colorado

Hello, am looking at a property near mine that has been vacant for more than 5 years. The siding is blowing off and the house is losing value. After much research I have discovered that that property has a Zombie title. The previous owners filed Chapter 13 bankruptcy and agreed to keep the house - keeping payments current on the house after the filing of the Chpt 13. Owners failed to keep up with the payments and the mortgage company asked for and was granted a Release of Stay on the house. The owners packed up and moved out of the house. The mortgage company, however, never proceeded with the foreclosure. Nothing was ever filed with the courts an the title remains in the previous owners name. Five years after the owner's moved out the house still sits. I would like to make an offer to the mortgage company to buy the property. I've contacted the previous owner and he did not know the title was still in his name but he is reluctant to talk with the mortgage company because he is afraid they will come back on him. I've tried talking to the mortgage company but they keep telling me that the loan was not foreclosed on and that it is not for sale. Somewhere there is a disconnect. The mortgage company should have foreclosed but they didn't. Does anyone have any suggestions on how to proceed with this?
