Need Help: Pre Foreclosure PCOA

Hey forum, 

Need some help. I'm looking at a flip in Denver and the issue I am running into is the seller is trying to find a way to occupy the property post close. Under pre foreclosure this is pretty outlawed. I'm looking at approaching it as a sub to deal or creatively. but either way the seller needs to go. anyone dealt with pre foreclosure PCOA before? Thank you!

 Not sure I understand the situation. Are you buying the home from the borrower? If so, I would not let them stay and make that a condition of the deal.

It is not illegal to have an owner occupy post close in a pre-foreclosure sale, although it is certainly a terrible idea.

I'd offer cash for keys. Under no circumstances would I let them stay. Are you using the foreclosure contracts from DORA? Please do if you are not.
