Florida Specific Foreclosures

Kristen Wagner
Posted

I am new to bidding on foreclosures.  My husband and I are looking to purchase something for my mother in law but the property is coming up for auction too quickly (in less than 2 days) to have any of the title companies we've spoken with run a full title search.  I have contacted the Clerk of the Court in the county and they are working to provide any information/liens filed against the property.  My question is- SPECIFIC to FLORIDA real estate, is there somewhere else I can search to find encumbrances on this property? Could there be major title issues lurking but not reported to the Clerk/filed on the property?  Any guidance would be helpful!  We have the final judgment that is forcing the foreclosure but want to be sure the mortgage forcing the sale is not 2nd or 3rd in line.  Thank you!

@Kristen Wagner You can get a title search within 24 hours..easytitlesearchdotcom  in Lake Worth, Fl, I’ve used them.

I often did my own, but you have to be careful...occasionally there is a misspelling in the name when recorded.  It won’t show up searching by name, but does show up if you know how to search by legal description.

Major things to look for...

-make sure it the 1st mtg foreclosing, but sometimes it’s second mtg, and often an hoa(the first mtg stays with the property in an hoa foreclosure).

- property taxes from previous years may be due, check the tax collector website. This year taxes will be due as they are paid at the end of the year.

- if there is an hoa, you will be responsible any past due fees and attorneys, regardless of whether a lien has been filed or not.

-an irs lien is No issue, they can redeem by paying you back within 120 days, but they never do, it doesn’t make sense for them to.
