Commission request after lease expires

Posted

Leased a commercial property for 5 yrs in Florida., agent charged 6% of 5 yrs lease value.

Lease expired, Tenant not interested in renewing the lease, currently on a month to month rent. Agent asking for commission on month to month rent. He's he entitled to it?

This is what the agent wrote to me.

"" The Tenant is continuing to pay the monthly rent and remaining on the premises, in effect a month-to-month tenancy. Your tacit agreement to this is confirmed by your cashing of their checks and allowing them to remain in possession of the property without eviction. That is a renegotiation of lease.""
