Commercial lease question
Hi, everybody. I live in Texas. I have one question that need your help. I just bought a business and signed commercial lease with 5 years term 2 weeks ago. However, I have a feeling that I couldn't run business anymore due to inexperience in running the business. At the same time, there are a tenant want to buy the business from me and take over the lease. Then, I notified the landlord that I wanted to transfer the lease to the new tenant. The landlord wanted to make a complete new lease with the new tenant. I don't have to sign and the new lease doesn't have my name on it. My question is am I safe or reliable anything for the new tenant. If the new tenant in default can the landlord use the old lease that I have with him to make me pay for the rent? Thanks for inputs. I wouldn't trust an email. Put together an agreement that references the lease, date of execution, property address, both parties names, and make sure he signs it specifically stating that he releases you from any and all liability under that lease.
