Question Regarding Purchasing A Property 'As Is"

Hi!

New here, but hoping to get a question answered.  I am in Alabama and purchasing a condo in a high rise.  The purchase is contingent on a home inspection.  I did my own inspection, but found the air conditioning not working.  I am prepared to go through closing if they can make the air conditioner work.  My question is that if they can make the air conditioner work and it works to my satisfaction for the purpose of the home inspection, but is not working when I do the walk through on the day of closing, can the seller keep my $50K earnest money if I back out of the deal?

My contention is that it would not be reasonable to expect me to go through with the closing if upon a walk through the day of closing, the air conditioner did not work.  I acknowledge I am buying 'as is', but on walk through it is not the same as I found it when I accepted the home inspection.

Has anyone had any experience in a case like this?
