Buying an owner's interest in a property- Potential SoCal Deal

Hi,

I appreciate all of the replies. I currently have a seller who is interested in selling his interest in a property with 2 SFR's (3/1 & 2/1) structures on it. He and his sister inherited the property from their mother and in the will it specified what house belongs to who.

At this time, the sister does not appear to want to sell. He wants to cash out.

Can he sell his interest without her approval?

I am aware that they currently share 1 water, sewer main. 

Title has sellers as 1-son & 2-sister - Lot 6500 and classified as Duplex. - no current financing.

How can you structure a sale of his interest? How would it be recorded? Can you create a note based on his interest or just one of the houses? How would you secure the note? Can you split lot and would it be worth it?

Since it will still have the sister on title, what are the liabilities of owning his interest. Thank you!
