Buying a house in Ohio
I purchased a house that is involved in a divorce, and also has liens. The husband owns the house and his name only is on the title. I purchased the home for 160k and both the husband and wife signed the contract. Now the title agency has found an unexpected (irs?) lien which didn't show up on any previous title searches. I believe that the 160k covers the loan amount and the liens, but doesn't cover what extra that the wife wants to cover child support, etc. There is no allocation in the contract, it just says that the seller is responsible to pay liens. The question is can I hold them to the contract if the 160k covers all banking and lien costs, or can the wife cancel because it doesn't give her the money that she needs? Also, is her signing a contract good enough to fulfill Ohio dower rights laws? He is willing to sign the title, she probably won't be. Is the title office required to be up front with me? They are friends of the seller.
