Buyer's Rights on Encroachment

I purchased a property and I had no idea that there was an encroachment issue. Our problem does not interfere with any neighbors, it's just that our structure is not far enough from the property line. Should we pursue litigation with the previous owner or did we become responsible for this issue once we purchased the property.
